1. About these terms
These Terms of Use ("Terms") govern your access to and use of this website. The website is owned and operated by Dr Fenwick Lab for Human Behavior & Technology, Unipessoal Lda., NIF/VAT PT518224910, with registered office at Rua Castilho 14C, 1250-069 Lisbon, Portugal ("Dr. Fenwick Lab", "we", "us" or "our"). Contact: support@drfenwick.com.
By using the website, you agree to these Terms. If you do not agree, do not use it. Our Privacy Policy explains how personal data is handled.
2. Website information is not healthcare or emergency support
Website content, self-help resources, the service-matching assessment and AI assistant are provided for general information, education and navigation. They do not constitute diagnosis, medical advice, psychotherapy, counselling, a clinical relationship or a substitute for assessment by a qualified professional.
Using the website, sending an enquiry or interacting with the AI assistant does not create a therapist-client, clinician-patient, coach-client, advisory or other professional relationship. Such a relationship begins only when expressly agreed in separate documentation.
This website is not an emergency service. If you or another person may be in immediate danger, may act on thoughts of self-harm, or needs urgent medical or mental-health support, contact the emergency services in your location or an appropriate crisis service immediately. In Portugal and across the EU, call 112.
3. Services and separate agreements
The website is an information, enquiry and booking channel only. It does not itself provide psychotherapy, counselling, coaching, corporate services, training, certification, licensing or any other professional service, and no professional service is delivered through the website.
All professional and paid services are offered and provided separately by Dr Fenwick Lab for Human Behavior & Technology, Unipessoal Lda. Website descriptions are invitations to enquire, not binding offers. Availability, suitability, territorial eligibility and professional scope are assessed separately by the company.
A service relationship begins only when the company expressly accepts an engagement under the applicable proposal, engagement letter, informed-consent documentation, booking terms, licence or other service agreement. Those documents govern the service. If a service-specific agreement conflicts with these website Terms, the service-specific agreement prevails for that service.
4. Bookings, prices, payments and cancellation
Bookings may be handled by Cal.com or another stated provider. Prices shown on the website are informational and may be updated. The final price, applicable taxes, payment timing, cancellation, rescheduling and refund conditions are those displayed or supplied before you confirm a booking or contract.
You must provide accurate booking and billing information and are responsible for checking appointment details and time zones. Nothing in these Terms limits mandatory consumer rights that apply to you.
5. AI assistant and assessment
The AI assistant uses automated technology and may misunderstand questions, omit context or produce inaccurate or inappropriate responses. Do not rely on it for diagnosis, treatment, crisis support, safeguarding decisions or other high-stakes decisions. Do not provide detailed clinical records, passwords, payment-card information or information about another person without authority.
Assessment results are general guidance generated from the answers selected. They are not a clinical conclusion, guarantee of suitability or decision about access to services. A qualified professional must make any clinical or service-suitability determination.
6. Permitted use
You may use the website for lawful personal or internal business purposes. You must not:
- use the website unlawfully, fraudulently or in a way that harms, threatens or impersonates another person;
- attempt to gain unauthorised access, bypass security, probe vulnerabilities or interfere with operation;
- introduce malware, scrape the website at unreasonable scale or use automated systems in a way that burdens the service;
- copy, sell, license, republish or commercially exploit protected content without written permission;
- misrepresent assessment or AI output as clinical advice or as a statement made by Dr. Ali Fenwick.
7. Intellectual property
The website and its text, visual design, graphics, videos, frameworks, tools, downloads, trade names and marks are owned by or licensed to Dr. Fenwick Lab and are protected by intellectual-property laws. This includes Red Flags Green Flags®, Digital Well-Being Counselling® and associated programme materials.
We grant you a limited, revocable, non-exclusive, non-transferable licence to view the website and use expressly downloadable self-help materials for your own non-commercial purposes. No professional-delivery, training, certification or licensing right is granted through website access.
8. Third-party websites and services
The website links to or embeds third-party services, including booking, forms, AI, video, podcast, community and social-media platforms. We do not control their availability, security, content or independent processing. Your use of them may be governed by their own terms and privacy notices. A link does not imply endorsement of all third-party content.
9. Accuracy and availability
We aim to keep content accurate and current but do not promise that all information will always be complete, error-free or available. We may update, suspend or withdraw website features without notice. Professional and educational information evolves and should be considered in context.
10. Website responsibility and liability only
This section applies only to use of the public website and its free informational features. The website does not provide professional services. Liability relating to clinical, coaching, training, licensing, corporate or other services offered separately by the company is governed by the applicable service agreement and law.
The website, assessment and AI assistant are provided on an “as available” basis. To the fullest extent permitted by law, we exclude implied warranties and do not guarantee that the website will be uninterrupted, error-free, secure, suitable for a particular purpose, or that general or automated content will be complete, current or accurate.
To the fullest extent permitted by law, we are not liable for loss or damage arising from:
- reliance on website, assessment or AI content instead of obtaining appropriate professional advice;
- inaccurate, incomplete or misunderstood automated output;
- third-party websites, platforms, content, outages, security incidents or processing outside our reasonable control;
- your failure to follow these Terms, safeguard your systems or provide accurate information; or
- events outside our reasonable control.
We are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data, or business interruption. These business-loss exclusions apply in full to users acting for professional or commercial purposes. They apply to consumers only to the extent permitted by mandatory law.
For a consumer, where liability cannot lawfully be excluded, we are responsible only for direct loss that was reasonably foreseeable and caused by our breach. For a user acting for professional or commercial purposes, our total aggregate liability arising from use of the free public website will not exceed €100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any mandatory consumer right. Any restriction that is invalid will be reduced only to the minimum extent necessary, and the remaining restrictions will continue to apply.
11. Privacy
Personal data is handled as described in our Privacy Policy. You are responsible for ensuring that information you submit about another person is lawful and authorised.
12. Changes
We may change the website and these Terms to reflect legal, security or service developments. The current version and effective date appear on this page. Continued use after an update means the revised Terms apply from that point, without affecting rights or obligations already accrued.
13. Governing law and disputes
These Terms are governed by Portuguese law. The courts of Portugal have jurisdiction, subject to any mandatory right of a consumer to bring proceedings in another competent court or rely on the mandatory protections of their country of residence.
Please first contact support@drfenwick.com so we can try to resolve the issue. Consumers may also access Portugal's Electronic Complaints Book. Information about recognised consumer alternative-dispute-resolution entities is available from Portugal's Direção-Geral do Consumidor.
